Vinnitskiy A.V. - Continuation of discussion on administrative responsibility of trustee in bankruptcy in light of preparation of the project of new Code of Administrative Offences of the Russian Federation pp. 1-18

Abstract: The subject of this research revolves the around the normative precepts pertaining to administrative responsibility of bankruptcy trustees (Part 2 and 3.1 of the Article 14.13 of the Code of Administrative Offences of the Russian Federation) in their systemic relation with other articles of the Code, regulatory norms of legislation on bankruptcy, as well as relevant provision of the legal doctrine. The author studies, generalizes and critically analyzes the vast case law of arbitration courts on the most important issues of administrative responsibility of bankruptcy trustees. The work employs the administrative practice of the Federal Service for State Registration, Cadastre and Cartography (Rosreestr). The conducted research allows making the following conclusions pertaining to administrative responsibility of bankruptcy trustees: 1) need for introduction of the concept of abuse of the right to initiate administrative prosecution of trustees; 2) impermissibility of the circumvention by the Rosreests authorities of the legislation on state control through the institution of administrative prosecution; 3) impermissibility of the frequently used extended interpretation of the Part 2 and 3.1 of the Article 14.13 of the Code of Administrative Offences of the Russian Federation; 4) reasonableness of clarification of the element of redundancy pertaining to the Part 3 .1 of the Article 14.13 of the Code of Administrative Offences of the Russian Federation; 5) fundamental impermissibility of the “mitigating requalification” of the act from the Part 3.1 to the Part 3 of the Article 14.13 of the Code of Administrative Offences of the Russian Federation. The conclusions are extrapolated to adjoining elements of administrative violations.  The author proposes consideration of the discovered general flaws of legal regulation in the context of work being conducted on preparation of the project of new Code of Administrative Offences of the Russian Federation.

Abstract: The research object includes the legal and methodological problems of license fees (royalties and flat payments) inclusion in the customs value of goods. The article analyzes the existing legislation in this sphere. The research subject includes the existing gaps in the national and international customs legislation in the sphere of movement of intellectual property objects across the border of the Customs union. The article defines the possible ways of inclusion of license fees into the customs value. The methodology of the research is based on the legal analysis and the content-analysis of the order of inclusion of license fees into the customs value of goods when crossing the border of the Customs union. The scientific originality consists in the complex study of customs and civil regulations in the sphere of intellectual property; the revelation of contradictions and gaps; suggestions about the enhancement of legislation in the sphere of movement of intellectual property objects across the customs border. In the author’s opinion, the custom authorities should take the following measures: it is necessary to define the documents establishing license fees payment as a condition for the goods selling; the calculation of interest payments when defining the customs value of goods, and the inclusion of agents’ fees into the customs value should be specified; it is recommended to distinctly represent the type of license fee and the order of its transfer, proved by the entries, in the license contract; it is necessary to regulate the disputable questions of deferred fixing of customs value.

Abstract: The author analyzes contents and specific features of the claim form of judicial proceedings in administrative proceedings. Topicality of this issue is due to the fact that the draft Administrative Proceedings Code of the Russian Federation has passed the first parliamentary reading. The object of studies includes the theoretical bases for the administrative claim as the means for the protection of public rights, as well as the newest Russian legislation regulating the judicial proceedings on cases arising of public law relations. The problem is that introduction of claims into the administrative judicial proceedings presupposes the use of the general rules for the claims proceedings, however, specific features of the public law dispute should predefine the differences between the claim proceedings on cases arising from public law relations and the claim proceedings in civil and arbitration process. The study was based upon the combination of scientific methods used for the studies of legal matters and processes. In order to reveal the contents and nature of the claims on public law cases the authors use the methods of comparative legal studies, systemic analysis, structural functional, formal logical methods, the method of legal modeling, etc. The author supposes that the procedural means for the implementation of the right to administrative claims is the administrative claim in court. The author notes special requirements to the contents of administrative claim, including those provided for by the Administrative Proceedings Code on obligatory participation of a representative in especially complicated cases. The author analyzes the conditions for filing in court an administrative claim, grounds for not accepting such a claim, when there was a previous court decision on the same issue, which came into force. In the opinion of the author the grounds for not accepting the case should be related with the same object and the same grounds for the administrative claim. The article includes analysis of periods for filing an administrative claim in court, and the issues regarding restoration of the of the period. It is noted that procedural periods are shortened, which is due to the specific features of public legal relations and value of the public law disputes. The conclusion is made that for the protection of public legal rights, the means and methods of protection should be chosen with due consideration for the specific features of a public law dispute.
