Abstract: The article considers the discussion on and the solution of the problem of children safety provision on railway transport, and the process of engrafting safe behavior on a railroad in 5-10-year-old children. Engrafting safe behaviour on railway vehicles is understood as an integral pedagogical process aimed at teaching senior preschool and junior school children how to recognize threats, anticipate the consequences of dangerous situations which can occur on transport, and forming a habit of conscious execution of rules of behaviour on railway transport and the culture and experience of safe behaviour. Education of children on the base of the ideas of personal safety, with the help of the advantages of the educating environment of an educational organization, society and the correlation between all the participants of the educational process (teachers, children and parents (or legal representatives) is the main idea of the “ABC of railroad safety” project. The research methodology includes classic and modern theoretical provisions of social sciences: at the philosophical level (the concept of the system approach to studying social phenomena; the system-integral approach); at the general scientific level (activity and system approach to studying the determinants of psychological development, personal development approach, axiological fundamentals of education, culturological approach reflecting the objective side of the culture of safe behaviour in various spheres, and how preschool and school children understand it).

Abstract: The article studies provocation as one of the forms of discriminational actions of citizens aimed at deliberate impairment of dignity and authority of a police officer. The authors reveal the reasons of provocative actions of citizens against police officers, the lack of experience of police officers in the prevention of provocative actions, the absence of regulations imposing legal responsibility of citizens for such actions in the Russian legislation. The authors analyze significant components of legal culture of a police officer which help to interact with citizens within legal boundaries. The authors use the methods of analysis and synthesis of the current scientific concepts considering the essence of legal culture and the ways of forming professional legal awareness of police officers; content-analysis used for studying mass media texts and helping to establish and problematize the research method and detect destructive strategies of interaction between citizens and police officers. The scientific novelty of the study consists in problematizing provocation as one of the forms of discreditation of a police officer by citizens, establishing the motive underlying this destructive behaviour, and the reasons hampering effective prevention of discreditation of police officers. The authors analyze the significance of forming legal culture of police officers for the prevention of provocative actions of citizens, give recommendations about the improvement of legal, moral and psychological training, professional training of police officers aimed at the formation of skills of prevention of provocative actions of citizens.

Abstract: the article presents the author’s research in the sphere of legal and organizational issues of establishment and realization of official and ethical standards of conduct. The role and influence of these standards on the mechanism of anti-corruption means is evident. The article contains an analysis of judicial practice in relation to this topic.

Suponina E.A., Gerasimova E.V. - Homelessness and neglect: on the nature of the phenomena and the correlation between legal terms

Abstract: The authors of the article carry out the normative and doctrinal analysis of the terms “homelessness” and “neglect”, and identify the reasons and conditions of these antisocial phenomena in Russian society.  The research object is the legal and pedagogical aspects of the process of prevention of neglect and homelessness of minors and the activities of public authorities both in Russia and abroad. The research subject is the terms “homelessness” and “neglect” as legal terms. Special attention is given to the reasons of homelessness and neglect of juveniles, in the first place, biological and social orphanage. The research is based on the dialectical, formal-logical (dogmatical), historical-legal, systems, linguistic and some other methods of scientific cognition. The priority methods were the sociological and formal-legal methods and the method of comparative jurisprudence. The scientific novelty of the research consists in the fact that based on the analysis of legal and essential roots of the two phenomena, the authors conclude that despite being formalized, they require fundamental review of the approaches to study and identification. It is necessary to transform the understanding of the model of juvenile behaviour which is connected with the recently changed basic scientific approaches in pedagogical psychology and social pedagogics. Taking into account the size of the problem of orphanage, the authors suggest aiming public social politics not only at the protection of rights of orphans and their adoption, but also at avoiding the cases of deprivation of parental care. The most active instrument in this context is the prevention of social orphanage by the child protection services which includes pedagogical, psychological, legal, social, educational and medical assistance to families with and without family disadvantages risk factors.

The author offers a ground base of the suggested differentiation of the principles of cooperation of he bodies of Internal Affairs with the public organizations in the sphere of ensuring of law and order and prevention of infringement of the law.

Kovalev D.V., Dombrovskii A.A. - On some problems occurred during the formation of the Federal Service of National Guard of the Russian Federation

Abstract: The authors of the article consider the changes in the federal legislation which were made during the formation of a new security agency in Russia - the Federal Service of the National Guard. A part of functions of other agencies were redistributed, and, in the authors’ opinion, sometimes unreasonably. As a result, particular directions are controlled by several security agencies simultaneously, which leads to overlapping or nonfulfillment of some tasks. The authors analyze Federal laws and some subordinate acts in order to detect overlapping duties assigned to different security agencies in search for a solution. The authors conclude that if one and the same function is performed by different agencies, it is hard to define the one responsible for faults. The authors suggest redistributing of functions among government structures in order to accumulate all the areas of activity in one service.

Abstract: The research subject is administrative protection of persons who assist internal affairs bodies or other law-enforcement agencies by reporting crimes. The research object is social relations appearing in the process of protection of rights and legitimate interests of road users. The aim of the article is the consideration of the legal framework regulating citizen participation in public order protection and public safety provision. The author gives special attention to the fact that a person, recording the fact of a crime in a lawful way, should be protected by the government. The research methodology is based on the dialectical, historic, system-structural, statistical, comparative-legal and other methods of jurisprudence. The scientific novelty of the study is determined by the necessity to improve the legal mechanism of preventing the violation of rights and legitimate interests of road users in the field of traffic safety provision. The author describes the problem and offers ways to solve it by means of citizen participation in public order protection and public safety provision. The author states that it is necessary to reconsider legal provisions regulating road traffic safety provision in order to increase the effectiveness of citizen participation. The results of the research can be used in law-making activities of public bodies, law-enforcement activities of responsible agencies, educational process, and scientific research of specialists in the sphere of road safety provision and the legal system improvement.

Abstract: The subject of this research is the innovative means of legal education of road users aimed at prevention of road traffic accidents. The aim of the research is to define prospects of developing and using applied innovative solutions of preventive nature presented in the form of digital applications and reference books, and video clips, to ensure the legal education of road users (drivers and pedestrians) as well as amateur participants of a criminal proceeding at the stage of preliminary investigation, in relation to road traffic crime cases (suspects/accused, victims, and witnesses). The research methodology involves the dialectical resaeerch method as well as the system of general and special research methods. The research is based on the analysis and generalization of research literature and judicial practice. The main conclusions of the research is that in spite of their practical importance today, practical preventive recommendations are made quite rarely. The authors underline that as a result of adopting the State Policy of the Russian Federation for developing legal literacy and sense of justice, forensics should now focus on the development of practical recommendations and guidelines for amateur participants of a criminal proceeding. Based on the results of their research, the authors conclude that development and use of electronic handouts and guidelines as the means of legal education offer great opportunities for criminalists and may become a priority for applied criminalistic researches that comrpise a pragmatic approach to forensics in the nearest future.

Abstract: The author analyzes the positive experience and the existing problems of policing in the Netherlands and the Russian Federation and the participation of citizens in public order protection. The author studies the Dutch police’s experience in the work with the population. The author reveals the strategy underlying the important developments in the sphere of citizens’ participation in public order protection, and author demonstrates the positive impact of this policy on citizen’s trust in and attitude towards the Dutch police. The article analyzes the legal framework, the forms of participation, and the main problems connected with the citizens’ participation in public order protection in the Russian Federation. The author applies the following methods: dialectics, abstraction, analysis, synthesis, deduction, and the method of intersectoral legal studies. Analyzing the Dutch experience, the author concludes that the participation of citizens in public order protection can improve the relations between the police and the citizens by means of the police integration into the society. The renewal of community law-enforcement units in the Russian Federation, taking into account the historical and foreign experience, can become an effective measure aimed at crime prevention. The involvement of citizens into public order protection has a huge potential. Russian citizens, as well as the government, are interested not only in their personal safety, but also in the reduction of crimes in general. Understanding and harmony in this field increases trust between the citizens and the government, and can promote the renewal of community law enforcement groups and improve the struggle against crime.

Abstract: The subject of the research is the social relations arising in the sphere of interaction between police and civil society. The author proceeds from the fact that participation of the civil society in law-enforcement activity is the condition and requirement for the development of the modern law-bound state. Reinforcement and development of partnership relations with the civil society institutions is an official activity of police in many countries. An attributive feature of social life in modern democractic states is the growth of social law-enforcement organisations. Police and civil society institutions are becoming important actors that perform law-enforcement functions of a modern state and social security partners. The methodological basis of the research is the general research (systems, functional, historical approaches) and special research methods (formal law, historical law and comparative law). In his research Nizhnik describes a partnership model of interaction between police and civil society institutions that would enable their efficient interaction in the sphere of crime counteraction analyzes the experience of interaction between police and society in the process of the performance of law-enforcement functions by different countries, defines specific features of the development of partnership relations between police and civil society institutions in the Russian Federation, gives a list of the main areas and forms of interaction between police and civil society institutions in Russia in the sphere of crime interaction, and describes social control as the main form of partnershp interaction between police and civil society institutions in Russia and social councils of the Ministry of Internal of Affairs of Russia as the main determinant of the police-and-civil society institution interaction in the sphere of crime prevention and counteraction.

Abstract: among all subjects assisting the bodies of Internal Affairs in the matter of public safety ensuring the citizen is viewed as the most important one. This citizen can offer various help to the law-enforcement bodies depending on the level of his or her social activity. In the presence of various forms, which the citizens’ participation may take in the matter of public safety ensuring it is possible to classify them into certain groups. This classification is based on the type of the citizens’ activity and this allows simplifying of the procedure of interaction with the bodies of internal affairs in the matter of public safety ensuring in public places.
