Abstract: The subject of this article is the problem of the introduction of distance learning technologies in the process of education by convicts in the context of digital transformation. The article examines the main normative legal acts regulating the right of convicts to education; characterizes the problems existing in the penitentiary system when convicts receive education; examines the experience of using distance learning technologies by foreign countries, evaluates the possibility of applying their experience in the Russian penitentiary system. The relevance of the topic is due to the fact that the possibility of convicts receiving education in Russia applies only to certain categories of convicts, which is considered ineffective in the current conditions of humanization. In addition, remote technologies that have proven their worth and importance are practically not used in the modern penitentiary system, which is seen as a serious disadvantage and requires special attention. The main purpose of the study is to develop the possibilities and prospects for the implementation of the process of distance learning of convicts in Russia. Along with general scientific methods, the authors also used special legal methods (system-analytical, comparative legal, statistical) in the preparation of this article. Based on the conducted research, prospects have been identified that contribute to the successful introduction of distance learning technologies into the Russian penal system. The optimal way to solve the stated problems will be the legislative regulation of the possibility of obtaining education using distance learning technologies for all categories of convicts, as well as the development of effective programs and courses through which persons serving imprisonment could gain knowledge and master a particular profession.

EDN: CHCYAW

Abstract: The article examines the issues of formation and legal regulation of the institution of administrative expulsion in the domestic legal system, as well as special institutions – temporary detention centers for foreign citizens of the territorial bodies of the Ministry of Internal Affairs of Russia. These institutions are, under the jurisdiction of the Ministry of Internal Affairs of Russia and possessing administrative legal personality, specialized regime law enforcement agencies established in order to comply with legal requirements in terms of: implementing the execution of administrative expulsion from the country, deportation or readmission, as well as isolation from society of immigrants subject to forced expulsion from the Russian Federation, deportation or readmission. The socio-economic and political changes that took place during the time period under consideration had an impact on the development of the democratization of society, manifested in respect and observance of human rights and freedoms in modern Russia, and led to the formation of legal norms governing the organization and activities of special institutions.  The analysis of legislative acts related to the legal regulation of administrative expulsion and special institutions was carried out, statistical data for 2022 were analyzed. The authors identify the current problems that arise in the activities of Temporary Detention Centers for foreign citizens, related both to imperfect interaction with other government agencies (FSSP), and personnel issues, and logistical support. In connection with the identified problems, the authors propose certain proposals for improving the activities of temporary Detention Centers for foreign citizens. In particular, it is proposed to increase the number of personnel; reduce or not involve civilians at all in the protection of temporary Detention Centers for foreign citizens; differentiate the activities of the Ministry of Internal Affairs and the Federal Bailiff Service so that this service is actually engaged in expulsion and deportation, that is, escorted foreign citizens from temporary Detention Centers for foreign citizens to places of official expulsion.

EDN: DJVXRW

Abstract: The subject of the study is the identification of factors affecting road safety by drivers of vehicles. The object of the study is the psychological and pedagogical factors influencing the provision of road safety by elderly drivers in the process of self-study. The authors carry out an administrative and legal analysis of the status of the driver of the vehicle within the framework of the legislation of the Russian Federation. Statistical data on road traffic accidents committed by drivers of various age groups for 9 months of 2022 are disclosed. The authors provide statistics on accident rates caused by drivers with different driving experience. The authors analyze the problem of limiting the use of vehicles by elderly drivers from the point of view of their social activity and the adaptation of elderly drivers to new conditions for ensuring road safety when driving. The authors pay special attention to the study of physiological and psychological changes occurring in older drivers and affecting safety when driving a vehicle. The authors propose the introduction of a specialized self-education program for elderly drivers as part of the prevention of road safety. In the course of the research, the dialectical method of scientific cognition was used, as well as a set of general scientific and special methods for studying factors affecting the safety of elderly drivers when driving vehicles. Implementation of scientific findings and recommendations in the practice of self-education of elderly drivers in safe driving. The main conclusions of the study are the system components obtained by the authors that affect road safety when driving vehicles by elderly drivers. A special contribution of the authors to the study of the topic is their proposed specialized self-study program. The authors note that programs should take into account the physiological and psychological characteristics of older people. They may include game directions for teaching changes in traffic rules, features of safe driving techniques applicable without the use of specialized polygons, as well as stress management methods and self-regulation techniques, a set of exercises to increase concentration. The novelty of the study lies in the disclosure of the main provisions of the program for self-education of elderly drivers in safe driving, taking into account their physiological and psychological characteristics.
The police and issues of the fight against terror and extremism
Komarov A.A. - The problem of criminal statistical casuistry of the category of "extremist crimes" based on examples of qualitative and quantitative analysis of their indicators. pp. 38-56

Abstract: The subject of the study consists of separate statistical indicators of extremist crimes in their relationship with the formal definition of the list of such acts in Russian legislation. Special attention is paid to various approaches to explaining the phenomenon of extremism by sciences other than criminology; the content of criminal law signs of the phenomenon under consideration; analysis of the place of extremist crimes in the structure of modern Russian crime; the problem of forming objective criminal statistics due to the adoption of novelties of administrative and criminal legislation; issues of registration discipline of this group of criminal encroachments and the latency of illegal acts. The purpose of the presented work is to put forward and verify the hypothesis of the presence of specific statistically significant dependencies in the registration of the phenomenon of criminal extremism and to analyze the impact of the completeness of the data obtained in this way on the conclusions of criminological science.  Methodologically, in our theoretical judgments, we relied on the universal method of dialectical materialism. Private methods consisted in using methods of statistical grouping of data, correlation analysis. The scientific novelty of the work carried out consists in the fact that we explained the reasons (origins) of the use of the criminal statistical approach in the formulation of the definition of extremism (extremist activity) by the legislator in 2002. By analyzing various approaches to understanding extremism from other sciences, the inconsistency of other formulations of the concept was determined. From a dialectical-materialistic point of view, a hypothesis has been put forward that criminal extremism belongs exclusively to political crime. They pointed to the limited volume of recorded crimes from the point of view of the "law of large numbers" as one of the main applied shortcomings that arise when analyzing indicators in modern criminological research. They justified the absence of a linear correlation between "prejudicial" administrative offenses and the corresponding extremist elements of crimes, pointing out, however, that the relationship of states between them persists at three analyzed stages. In the conclusions, we pointed out the key problems of the formation of modern criminal statistics in terms of the formation of our objective ideas about the state of the phenomenon of criminal extremism.
