Abstract: The subject of this research is the Federal Law “On the Roads and Road Activities in the Russian Federation…” No. 257-FZ from November 8, 2007, as the foundation of legislation of the Russian Federation on roads and road activities. The object of the research is the legal norms, contained in the law, that regulate the core functionality of the roads and driving. A special attention is given to the proposition on improving these legal norms by changing them, as well as introducing additional articles that would allow eliminating the gaps in legislation on roadways and road activities. The scientific novelty consists in the fact that the author is first to analyze the foundation of the legislation of the Russian federation on roads and road activities, detects the key flaws and gaps in the law, and devises  measures for remedying the imperfections that impede the development of the road system. The proposed changes allow a significant concretization of the norms that regulate the use of roads, as well setting the responsibility for the authorities of executive branches and their leadership that are not performing their duties.

Abstract: The subject of the research is the positive experience of foreign countries in the sphere of legal regulation of the road sector management. The research object is the system and the structure of executive authorities of Germany and the USA and the methods of their activity. Special attention is paid to the possibility of use of the positive experience of Germany and the USA for the development of the system and the structure of executive authorities of the road sector of the Russian Federation and the country’s road network. The author uses the systems method, the comparative-legal, formal-logical, historical and other methods. The scientific novelty of the study lies in the analysis of the system and the structure of the executive authorities of Germany and the USA functioning, their interaction with road users, and the order of adoption of the legislation regulating the use of highways and the road works, the responsibility of authorities in these countries.

Abstract: The article analyzes the provisions of the Federal law "On automobile roads and road activities" and Code of the Russian Federation "On administrative offences" regarding imposition of administrative responsibility for both road users (individuals and legal entities) and officers of the traffic control sector for violations in repair, roads maintenance and safety. The authors propose the measures for improvement of the legislation on administrative offences, including toughening of responsibility and introduction of additional chapter in the Special part of the administrative code. The authors use the system, the comparative legal and the formal logical methods. The improvement of the Code Of The Russian Federation "On administrative offences" and the Federal law "On automobile roads and road activities.." No. 257-FL dated 8.11.2007  through the inclusion of new rules on liability in the sphere of roads and road-related activities, will allow not only to improve the responsibility system of road users and organizations involved in the operation of roads, but also to codify the responsibilities of road management, as well as their managers.
