Shatilov S.P. - Law enforcement function of the state as theoretical legal category pp. 43-55

Abstract: The object of this research is the public relations emerging in the process of formation and implementation of law enforcement function of the state. The subject of this research is the theoretical methodological problems and legal grounds of law enforcement function of the state. The author meticulously reviews the main approaches towards recognition of law enforcement function of the state, provides argumentation to such recognition from the perspective of the norms of Russian language alongside the scholars’ relation to law as the positive or objective category, as well as analyzes the content of law enforcement function. The scientific novelty consists in the first attempt in Russian jurisprudence to comprehensively examine the theoretical methodological problems and legal grounds of law enforcement function of the state. The author concludes that the law enforcement function carries features that characterize it as an independent function of the state. In accordance with the standards of Russian language, it is more appropriate to call the function of the state on protection of legal norms the law enforcement function. The law enforcement function implies ensuring law and order and strengthening of lawfulness.

Abstract: The subject of this research is the normative legal acts that regulate the work of the law enforcement agencies on the fight against child neglect during the Great Patriotic War. The object of this research is the public relations emerging as a result of work of the law enforcement agencies on this matter. The author meticulously reviews the causes of neglect, as well as gives special attention to the key directions of activity of the department on the fights against child neglect and homelessness, as well as children correctional facilities. The scientific novelty consists in the fact that for the first time in Russian jurisprudence, the author attempts a comprehensive analysis of the normative consolidation of the work of law enforcements aimed at fight against child neglect and homelessness during the Great Patriotic War. Conclusion is made that under the circumstances of the newly started war, the problem of child neglect becomes sizable; however, the established system of law enforcement agencies aimed at fighting child neglect and homelessness provided an efficient execution of the delegated functions. The archive materials testify to the fact that the law enforcements successfully fought the mass homelessness and neglect.

Abstract: The object of this research is the public relations that emerge in the process of the work of law enforcement agencies regarding the evacuation of population and material values during the period of Great Patriotic War. The subject of this work is the normative legal acts that regulate the activity of the law enforcement agencies on this matter. The author carefully examines the key directions of the work of law enforcement agencies, namely: resolution of the questions of displacement, employment, and living assistance of the evacuated citizens and refugees; realization of protection of the socialist property; preservation of social order; struggle against work evasion; realization of the preventative measures on avoidance of the spy covert actions of the German special services; realization of control over execution of sanitary rules in crowded places; placement of evacuated children from the near-front zones. The scientific novelty consists in the act that the author is first in the Russian jurisprudence to conduct a complex analysis of the organizational-legal foundations of the work of law enforcement agencies on ensuring evacuation of population and material values during the period of Great Patriotic War. The efficient organization of work, regulated by the normative-legal acts of the war time, allowed the law enforcement agencies carrying out the set tasks on evacuation, reception and placement of population and material values under the severe conditions.

Abstract: The subject of this research is the unlawful forms of realization of the law enforcement activity by the Soviet law enforcement agencies during the Great Patriotic War. The author analyzes the organizational forms of the law enforcement activity, such as study, generalization, and distribution of the positive experience of ensuring the legal order, selection and training of the law enforcement officials, etc.; as well as material-technical, such planning, analysis, preparation of the reports, execution of documents, clerical correspondence, registration of facts of the legal violations, and others. The scientific novelty consists in the fact that the author is first in the Russian jurisprudence who attempted comprehensive analysis of the normative consolidation and mechanism of realization of the unlawful forms by the Soviet law enforcement agencies during the Great Patriotic War. The conclusion is made that the unlawful forms can be subdivided into organizational and material-technical. The unlawful forms of realization in both, peace and war time, preceded the legal, encouraged the collection, processing, and analysis of the information; and as a result, the efficiency of their realization directly affected the efficiency of realization of the law enforcement activity during the Great Patriotic War.
