Alimova Y.N. - Legal norms in the context of sociocultural transformations: philosophical-culturological analysis pp. 1-8

DOI:
10.25136/2409-7144.2019.12.31035

Abstract: The goal of this work is the analysis of interaction between the key forms of existence of social and legal norms. The subject of this research is the dynamics of development of the legal norms depending on the frames of sociocultural context, reflecting in public consciousness the priority of irrational (myth) and rational (logos) spatio-temporal perceptions. In such context, myth and logos are viewed as the fundamentally different methods of storage and transmission of the socially important information, which allow forming worldview frames of the rational and irrational mindsets. Methodology is based in the cultural-philosophical analysis for comparing the two main types of legal consciousness, law enforcement and lawmaking. In the course of juxtaposing the modern forms of “mythological” (customary law) and “rational” (positive law) levels of the existence of law, the author determines the peculiarities of their interaction using the example of the phenomenon of “archaization of law”; as well as demonstrates the boundaries of this phenomenon in the context of modern sociocultural transformations. The results of the conducted research became the conclusions important for specification of boundaries of the permissible interpretations in situation when the norms of customary law collide with the norms of positive law. In such case, the law enforcement practices face a dilemma: whether the reference to a custom in case of unlawful actions is a mitigating factor or aggravating factor. The scientific novelty consists in establishing worldview framework of “archaization of law”, and determining correlation of this question with the philosophical problem of the universal, peculiar and singular (and thus, with the concept of “international law”). The author substantiates the conclusion on the dual character of alignment of the values of positive law with the custom and tradition.

DOI:

Abstract: This article explores separate elements of the socioeconomic environment exerting influence upon the reproductive plans of women of various generations. The goal of this article is to determine the factors contributing to or impeding the realization of the reproductive plans of women and the variability of this influence. The generation of indigenous minorities born in the 1990’s, and now reaching the childbearing age demonstrate visible changes in the reproductive plans of the population of the northern region, which was formerly known for its high birth rate. A direct correlation is determined between the model of the parental family and plans for childbirth in the families of respondents. The information base consists of materials from the socio-demographic polling conducted through questionnaires from thirteen administrative districts of Yakutia during 2017-2018 (n = 833). It is established that the decision-making for having a child is greatly influenced by financial situation, and that living conditions along with uncertainty of tomorrow and state of health impact the reproductive plans of urban women more than rural women. The results of this research allow concluding that the place of residents of the respondents is a socioeconomic element of its own, exerting substantial influence upon the reproductive plans of the generations, which underlines the importance of consideration of this factor in development of measures of birth support on the state level.

The study was conducted via the method of content analysis of all releases of compilation of scientific articles of the faculty of Sociology of Altai State University “Sociology in the modern world: science, education, creativity”. The authors analyzed 352 articles of students and master’s degree students. It was determined that most often the students of sociology study the problem regarding the Russian society overall; the spheres of education, family, politics and youth problems also enjoy popularity. In top five are also the topics associated with theory, methodology of sociological knowledge, and problems of sociology of culture. The majority of articles carry theoretical character; but if they contain an empirical part, it is usually the original research of authors of the articles, rather than secondary data analysis. The research results may be valuable to other scholars engaged in this problematic.

Leushkin R.V. - Network forms of self-organization and management of social systems in the context of informatization and virtualization of modern society pp. 256-268

DOI:
10.25136/2409-7144.2019.12.31707

Abstract: This work examines the specificity of virtual socio-communication space and the forms of social and political self-organization emerging within it. Due to expansion of information and communication technologies, the modern social space is subject of the processes of virtualization and informatization. On the one hand, these processes lead to the establishment of grounds for future information society; while on the other, cause a number of undesirable consequences such as information warfare, cyberterrorism and information pollution. The understanding of structural characteristics of information society, namely the emerging within it forms of management and self-governance of social systems, would allow preventing the negative effects of informatization. The research leans on the social systems theory of N. Luhmann, classification of communication types of M. Mcluhan, wave model of society of A. Toffler, concept of power of M. Foucault, and post-structuralist concepts of J. Baudrillard and G. Deleuze. The process of informatization of socio-communication space of society leads to the emergence of new forms of political organization and self-organization of social systems, establishment of virtual and network forms of governance. The main peculiarities of these forms of governance include: deterritorialization, rhizomaticity, cybernetization. Despite the difficulty in determination of the network forms of governance, the author observes more and more indirect criteria of their existence, which increases the need for studying their fundamental characteristics.

Mass media publications for the period 2009-2019 selected by the information-analytical system “Integrum” became the materials for this research. Software program MAXQDA was used for processing and analysis. The scientific novelty consists in consideration of the insufficiently studied within Russian science topic of children’s participation, as well as in analysis of discourse on the matter created by mass media. The research demonstrated that participation is interpreted as a practical, initiative, socially important activity, as civic participation and unachievable ideal of social development associated with implementation of the basic principle of Convention on the Rights of the Child.
