Deryugin R.A., Malykh A.A. - Forensic processing of bows: types, features of construction, and the problems of expert practice and identification

Abstract: Currently, bows along with other types of throwing weapons are often dealt with in the work of forensic departments of the Ministry of Internal Affairs as objects of forensic processing. Recently, the law has defined the guidelines of forensic processing of objects in terms of their belonging to such a class of throwing weapons as bows, but at the same time, there’s no unified procedure of marking the processed objects. The research subject is various types and the features of construction of bows, the problems of legislative regulation of bows circulation, and the urgent problems of forensic processing of bows. The popularisation of archery and the growth of the number of bows owners in society, as well as the accessibility of bows have defined the necessity to regulate bows circulation. However, despite the 2020 changes in certain legislative documents, many crucial issues of bows using haven’t been settled. The authors consider some topical and unsolved problems of forensic processing of bows and formulate the conclusions about throwing weapons marking using technical means, the rules of licensing, storage and circulation of bows. The authors consider the rules of forensic processing of bows as cold and throwing weapons.

Abstract: The paper considers certain peculiarities of acquisition and application of information about connections between subscribers and subscribers’ units in the investigation of breach of traffic regulations and vehicles exploitation rules. The authors study the judicial practice and reveal the investigative and evidential potential of acquisition of information about connections between subscribers and (or) subscribers’ units in investigation of crimes described in articles 264 and 264.1 of the Criminal Code of the Russian Federation. The authors apply the set of general scientific and special research methods including the normative-logical method, system method, synthesis, analysis, deduction, induction and other research methods. The scientific novelty consists in the revelation of the capacities of use of information about connections between subscribers and (or) subscribers’ units in investigation of crimes described in articles 264 and (or) 264.1 of the Criminal Code of the Russian Federation, based on the particular examples of law enforcement practice.

Abstract: The authors of the article examine issues related to detection, fixing, withdrawal and official registration of footwear traces and traces of hands at the crime scene. Special attention is paid to the methods of withdrawal of footwear and hands traces because these are the traces that are found at the crime scene most frequently. In its turn, accuracy and professional qualities of a forensic specialist allow to preserve trces and later use them during expertise. In their research the authors have used general research methods as well as specific research methods such as the standard logical method, systems approach, synthesis, analysis, induction, deduction and other research methods. The main conclusion of the research is that despite a great variety of methods used to withdrawal material evidence such as traces of hands and footwaer, the most efficient method is still the withdrawal of a trace together with an object. This is a rather universal method that keeps material evidence intact.

Abstract: The article considers certain tactical, criminalistic and procedural aspects of acquisition of information about the connections between subscribers or subscribers’ units, and presents the researchers’ opinions about the concept of “integrity” in relation to such investigating activities. The author analyzes the structure of stages of this investigating action and offers the recommendations for the improvement of its effectiveness. The author notes the importance of the results of this investigating action, since the information about subscribers and their connections is of a particular importance for criminal cases investigation. The author applies the set of general scientific and special research methods, including the normative-logical method, the system method, analysis, synthesis, deduction, induction and other research methods. The scientific novelty of the study consists in the fact that this research is devoted to the peculiarities of acquisition of information about the connections between subscribers and (or) subscribers’ units. In the context of the development of the information society, in which the means of communication can be used not only be law-abiding citizens, but also by criminals, the investigating action, specified in the article 186.1 of the Criminal Procedure Code, helps law-enforcement agencies effectively realize the priority areas of activity, such as the investigation and the solution of corruption crimes, organized crimes and other grave and especially grave crimes.

Abstract: The research subject is the range of tactical and criminalistic issues of investigating action provided by the article 186.1 of the Criminal Code of the Russian Federation “Acquisition of information about the connections between subscribers and (or) subscriber devices”. The author considers the tactics and the legal nature of acquisition of information about the connections between subscribers and (or) subscriber devices. Besides, the paper studies certain aspects of interaction of the parties of criminal procedure (prosecutor, court and investigator) and other subjects of criminal procedure. The author applies the set of general and special scientific methods including the normative-legal method, the system method, analysis, synthesis, deduction, induction and others. The scientific novelty of the study is conditioned by the fact that acquisition of information about the connections between subscribers and (or) subscriber devices has been included in the criminal code not long ago, therefore, at present there is no common opinion about the tactics of its implementation. Besides, some problems of its legal nature haven’t been solved yet, leading to difficulties in its application.

Abstract: The article discusses some aspects of the use of special forensic techniques designed to extract information from mobile devices. Moreover, the author of the article identifies the problems of procedural implementation of evidence in criminal proceedings obtained by law enforcement agencies using forensic techniques allowing to obtain information not only about about the connections between subscribers but also the files and data stored in the memory cell phones. The author also notes the need for the use of hardware and software systems such as "Segment C" and "UFED" by law enforcement authorities in order to improve the efficiency of their investigation of criminal cases. The author has used general and special research methods inculding legal logical method, systems analysis, synthesis, analysis, deduction, induction and others. The novelty of the research is caused by the fact that in today's society which can be considered the information-based society, analysis and processing of information regarding the connections between subscribers and (or) subscriber units is one of the promising trends in technical and forensic security criminal investigation as it requires the use of and the development of the latest special forensic techniques.

Deryugin R.A. - On the issue of use of the Universal Forensic Extraction Device (UFED) for analysis and processing of data about subscribers and (or) subscribers’ devices

Abstract: The paper considers some aspects of use of the Universal Forensic Extraction Device (UFED) in investigation and expert practices. The author describes the essence of this device and its technical capabilities, and explains the necessity to use it by agencies of preliminary investigation. Moreover, the author raises the issues of procedural registration of the results of the collection of data about subscribers and (or) subscriber devices using UFED, and offers the ways to solve them. The author applies the set of general scientific and special research methods including the normative-logical method, the system method, analysis, synthesis, deduction, induction and others. The novelty of the research consists in the fact that nowadays, due to the increase of the number of mobile devices and registered subscribers, including criminals, the information, transmitted via mobile devices, should be controlled. The analysis and processing of the information about connections between subscribers and (or) devices is one of the promising directions of the forensic ensuring of criminal investigations.
