Fedotova Y.G. - Current status and development of the participation of citizens and their associations in ensuring national security of the Russian Federation

Abstract: The subject of this article is the attraction of citizens and their associations to participate in provision of national security of the Russian Federation. The author analyzes the nature of the current military threats and dangers, especially their occurrence and distribution in the observed geopolitical situation, as well as specificity of activity of the terrorist organizations in the information space. The work presents the experience of foreign countries in attraction of institutions of civil society towards participation in insurance of the information security of the country, which may be relevant in daily activities or during the electoral period. The article establishes the basic direction in participation of civil society in ensuring the information security of the Russian Federation in the information-psychological sphere, as well as expresses proposals regarding the promising fields in the work of public organizations of patriotic or other social and political orientation. The author reveals the concept, content and forms of e-democracy as the countermeasures for the information threats to the country, as well as gives characteristics to the role of public control in this regard.

Abstract:   The subject of this research is the various forms of citizen participation in ensuring national security and defense. Based on the analysis of theoretical approaches towards determination of the forms of citizen participation in government administration, the article defines the historically substantiated and codified in the current Russian legislation main forms of citizen participation in defense of the country. Based on the characteristics of the modern military threats, the author detects the need for expansion of the forms of citizen participation in ensuring national security. The article establishes the unity of the forms of citizen participation in ensuring national security, presents their classification, as well as gives special attention to the demarcation of citizen participation that may or may not suppose inclusion into the ranks of a military organization in accordance with method of legal regulation of the corresponding public relations, legal status of citizens as the subject of legal relations and the character of mutual activity of the citizens and the authorized government bodies.

Fedotova Y.G. - Model legislation of the CIS-countries in the sphere of involvement of civil institutions in the national security of state

Abstract: This article is dedicated to the legal regulation of the institution of civil participation in provision of national security within the model legislation of the CIS countries. The author explains the vectors of development of the legislation in this sphere and states the problems that are currently in the stage of its formation of the model legislation, which regulates civil participation in patriotic upbringing, provision of border security, and counteraction of terrorism and extremism. Based on the study of the modern geopolitical situation, the author demonstrates the necessity to expand the forms of civil participation in ensuring national security. Analysis is conducted on the model laws of the CIS countries that regulate the civil participation in provision of national security, as well as on the nature of modern military threats. The author gives characteristics to the institution of civil participation in provision of national security and the legal status of citizens as the constituents of legal relations on provision of national security. Recommendations are made regarding the 2016-2020 Interparliamentary Assembly of Member Nations of the Commonwealth of Independent States plans to develop model laws on participation of civil institutions in provision of national security and the legal regulation of the activity of private military contractors.

Abstract: The article discusses social control as a form of citizens participation in the guaranteeing of the national security. The characteristic of modern military threats and dangers is shown. Based on the analysis of the goals and objectives of social control and the areas of its application, the author reveals the capacities of subjects of public control in the solution of the problems of ensuring stability of the constitutional system, the country's defence capacity and state security, which may contribute to the task of bringing together the state, society and the individual for the protection of the Russian Federation, as set out in the 2014 Military Doctrine of the Russian Federation. The author uses logical, sociological, formal-legal research methods, the methods of comparative analysis and interpretation of legal norms. The author proves that in the contemporary geopolitical circumstances characterized by the use of the protest potential of the population, public control is not the source of threats, but the effective means of countering them. The article presents the arguments in favor of the feasibility of the activities of public inspectors, non-profit organizations, cartel parties and other institutions of civil society, not only in the private but also in the public interest, in particular in the field of information and social adaptation of a person, which would contribute to the protection of the constitutional system, ensuring the country's defence capacity and the security of the Russian state.
